RULES OF EXCURSIONS AND MOTOR TRIPS

§1.

Glossary

For the purposes of these Regulations, the following expressions shall mean respectively:

Organizer - MOTOpodrozni.pl sp. z o.o.

Participant - A person participating in a Travel Event organized by MOTOpodrozni.pl sp. z o.o. , as a driver;

Passenger - A person participating in a Travel Event organized by MOTOpodrozni.pl sp. z o.o., but who is not the driver;

Tourist event - trip organized by MOTOpodrozni.pl sp. z o.o., hereinafter referred to as the Event;

Supervisor of the expedition (event) - person presiding over the Tourist Event, representative of the Organizer, authorized to make decisions on behalf of the Organizer.

 

§2.

General provisions

By entering into a contract for participation in a tourist event, the Participant accepts the terms and conditions of these Motor Expedition Regulations and agrees to abide by them.

 

§3.

Responsibilities of the Participant

  1. Participant of the Event must be at least 18 years old.
  2. The participant is obliged to:
    1. to comply with the law, including traffic regulations and prevailing customs generally accepted in the country where the Event takes place, and not to infringe on the rights of third parties,
    2. comply with the rules of the trip as set forth in the contract, the T&Cs and the schedule of the Event;
    3. detailed study of the itinerary and route of the expedition, especially in terms of assessing your own skills and fitness;
    4. have a valid ID card, or passport and, if required in the country, also a visa,
    5. if traveling on your own motorcycle, in your own vehicle - to have a valid third-party liability insurance policy, ASSISTANCE insurance, and to ensure that the vehicle is in proper working order;
    6. if traveling on a motorcycle, or in a vehicle not owned by the Participant - to have authorization to use the vehicle from the owner of the vehicle, including outside the Republic of Poland and in a form appropriate to the requirements of the country;
    7. have a valid driver's license, appropriate for the type of vehicle used, category A, or B, and if the Event is organized outside the Republic of Poland - a driver's license category A, or B drawn up in English or an International Driving License;
    8. if traveling on your own motorcycle, in your own vehicle - to have a navigation device, a set of basic wrenches, a tire repair kit, including, in particular, cartridges, tubes, basic equipment for changing tires yourself and basic supplies, including chain oil and grease, as well as a first aid kit;
    9. to have appropriate clothing for the type of vehicle used - in particular, when using a motorcycle - a helmet, protective gloves, protective clothing and shoes
    10. to enter into its own navigation device the points specified in the itinerary referred to in § 5(1) of the Regulations and, in case of failure to comply with the obligation, to incur the costs that may arise in connection therewith,
    11. carrying out the instructions of the Event Supervisor,
    12. to refrain from consuming alcohol and intoxicants during the Event.
  1. The Participant acknowledges and accepts the circumstance that the route of the Event may run in extremely difficult weather conditions, i.e. after dark, very high or very low air temperature, during heavy rain or snow, or during strong wind.

 

§4.

Passenger Responsibilities

  1. The passenger must be at least 13 years old.
  2. If the Passenger is a minor, the written consent of the legal guardian is required for the child's participation in the Event.
  3. The obligations of the Participant listed in § 3.2 shall apply to the Passenger accordingly.

 

§5.

Responsibilities of the Organizer

  1. On the day of commencement of the Event, the Organizer provides the Participants with the so-called ROAD BOOK, containing the points specified in the itinerary, in particular hotels, parking lots and compensation points.
  2. The detailed obligations of the Organizer, especially with regard to the provision of insurance, are regulated by the T&Cs, which are an integral part of the contract.

 

§6.

Rights of the Expedition Supervisor

  1. The Expedition Supervisor shall have the right to exclude the Participant or Passenger from the Event if it is determined that the Participant or Passenger does not comply with the provisions of the Agreement, the T&Cs, the Regulations or the schedule of the Event, and in particular in the case of:
    1. remaining in a state of intoxication by a Participant or Passenger during the time scheduled in the Event schedule for driving the vehicle,
    2. Failure of the Participant to have the skills, physical conditions and technical preparation or appropriate equipment to participate in the expedition,
    3. dangerous behavior of the Participant on the road, endangering the life and health of other road users.
  1. The expedition chaperone may subject the Participant's driving skills to verification before the start of the Event.

 

§7.

Exclusion of the Participant from the Event

  1. In the event that a Participant or Passenger is excluded from the Event for reasons other than being under the influence of alcohol (§ 6, section 1, item 1), the Organizer may - to the best of its ability - provide assistance, especially in transporting persons, items or equipment to the next point of the Event and to the starting or ending point of the Event, but is not obligated to do so.
  2. In the event that a Participant or Passenger is excluded from the Event due to being under the influence of alcohol (§ 6 paragraph 1 point 1), the Organizer shall not provide the assistance referred to in paragraph 1.

 

§8.

Transport

  1. The Organizer does not provide transportation of Participants and Passengers to and from the starting point of the Event.
  2. The Organizer shall provide transfer of Participants and Passengers from the airport or transfer center by means of transportation other than airplane to the place of commencement of the Event and from the place of termination of the Event to the airport or transfer center.
  3. The condition for providing the transfer referred to in paragraph 2 is to inform the Organizer of the planned time and place of arrival or arrival and departure or departure, no later than 30 days before the commencement of the Event, at the e-mail address admin@motopodrozni.pl And receiving a feedback message.
  4. The Organizer may provide transportation of the Participant's vehicle under the terms of a separate agreement.

 

§9.

Additional provisions

  1. The Organizer reserves the right not to allow the Participant whose vehicle does not meet the technical requirements for the route specified in the itinerary to participate in the Event.
  2. If you are making the trip on your own motorcycle, in your own vehicle, the Organizer recommends that you perform a service inspection at the showroom of an authorized dealer of the vehicle brand in question before returning it for transportation.
  3. In the case of taking a trip on one's own motorcycle, in one's own vehicle, the Organizer does not provide navigation equipment, repair kits or any consumables and spare parts.
  4. The organizer does not provide medical care, but only insurance, according to the rules set forth in the T&Cs that are an integral part of the contract.
